Although Minnesota does not require health insurance companies to accept your policy application, it is important to note that the law does protect you in other ways.
If you do have (or get) an individual health insurance plan in Minnesota, you have the following rights:
- If you are limited to only seeing doctors in your health insurance company’s network, a provider must be available within a 30 mile/30 minute drive. If not, you can see a doctor outside of the network. For specialist’s, the limit is 60 miles or 60 minutes.
- Emergency room care and other emergency treatment (risk or potential risk of losing life or limb) must be covered, even if the hospital or care provider is not a part of your network.
- You cannot be billed for a treatment if your insurance company covers it. A provider must send the bill directly to the insurance company, although you might get a record after it has been paid.
- By Minnesota health insurance law, health insurance providers must pay a claim within 30 days of receiving it. If they don’t pay, you cannot be held responsible for that bill.
Keep in mind that, although you are protected, there are a number of laws that work in the insurance companies’ favors as well. For example, plans are not required to give you free access to prescription drugs. If prescription drugs are included, there may be limits or you may only be covered for generic versions. Most of the time, over the counter drugs are not included, even if your doctor prescribes them.
